Terms and Conditions for Users
1.) Sleeplater is a trading name of EverythingText.com Limited. It is a limited company incorporated in England and Wales (Company Number 04313478). It conducts an sms service sending special offers from its customers to its users and its registered office is 218 Downs Barn Boulevard, Downs Barn, Milton Keynes, Bucks, MK14 7QH
2.) By using the Sleeplater service you, the user, agrees to be bound by the following terms and conditions numbered 3.) to 18.) These terms and conditions are legally binding between you and Sleeplater. Sleeplater may change these terms and conditions at any time and these changes shall become effectively immediately. In accepting these Terms and Conditions, Sleeplater has not made, and you are not relying upon, any statements, representations, promises, or undertakings, whatsoever that are not contained herein.
3.) You, the user agree to provide us with accurate and correct information about you including your date of birth. You, the user will inform Sleeplater if you change your mobile number or address by using the 'change details' link in your profile. Your rights and obligations under these Terms and Conditions are personal to you and cannot be assigned to anyone other than yourself.
4.) You, confirm that the mobile number you have provided us with belongs to you and is registered under the name you provide us with.
5.) From time to Sleeplater may need to contact you or send you information by email. By signing up to the service you agree to let us do this.
6.) You, the user give Sleeplater permission to process your details to 'match you' to the offers we believe to be of interest to you. This processing may continue after termination of these Terms and Conditions.
7.) Sleeplater is not responsible or liable for any offers you may receive. The terms and conditions of the Company sending you an offer, including their right to refuse admission, will always apply if you decide to take advantage of their offer.
8.) Sleepleter will not pass your details on to any person or party not a part of everythingtext.
9.) Sleeplater will not charge you a fee for our service. Any charges incurred are likely to be an issue with your mobile phone service provider and are not the responsibility of Sleeplater. We cannot and will-not reimburse you for any charge your mobile service provider charges for receiving texts from Sleeplater.
10.) Whilst sleeplater sets guidelines for the content of text messages sent, Sleeplater is not responsible for their content. Please report any misuse of the service and any spam and junk texts to abuse@sleeplater.co.uk
11.) The SMS service is only available on an 'as is' basis, and the Company has no responsibility if the service is unavailable or non-working at any time. There is no guarantee that messages will arrive once they have been sent - we submit them in good faith into the SMS system but cannot control what happens with the transmission after that. No consequential loss of any kind will be compensated.
12.) Currently the service is only available for mobile phones registered in the United Kingdom although the phone itself can be virtually anywhere in the world - phones registered in many other Countries might also work.
13.) The sending of Spam SMS is strictly prohibited. Any spam that is sent is the responsibility of the Customer (the individual or organisation sanding the sms via Sleeplater), and the Customer also agrees that he will reimburse the Company immediately on demand for costs of any sort incurred by the Customer sending spam text. If any text is sent that appears to be spam then the Company reserve the right to immediately charge an additional 25p per message, and cancel the Customer's account at the discretion of the Company. The Company reserves the right to delay sending a message which it considers may be Spam.
14.) Sleeplater reserves the right to send any number of texts to the user. We endeavour not exceed the quota provided by the User however we cannot guarantee this and are not responsible for any breach of the number. Signing up to Sleeplater does not entitle or guarantee you the user to any texts or offers. Sleeplater reserve the right to send the user no texts and/or no offers.
15.) Sleeplater may amend these Terms and Conditions, at any time, by providing you with a notice or by posting such amendments or new Terms and Conditions on the Sleeplater website.
16.) Any disputes of any kind relating to this service will be settled only in the English Courts under English Law.
17.) Sleeplater may terminate any agreement to which these Terms and Conditions apply by giving written notice to the other; such termination shall take effect immediately or after such periods as specified in the notice.
18.) Sleeplater may at any time close an account, cease to offer service or stop you from gaining access to the Sleeplater website and thereby any Sleeplater service offered there for any reason without notice.
